Jeremy Mayfield Latest: Stay Overturned, Sold Team to John Carter

Here’s the latest on the Jeremy Mayfield saga that I’m tired of following, but is still the biggest news story right now. The Fourth Circuit U.S. Appeals Court has overturned the stay of Mayfield’s suspension by NASCAR. That’s basically as far as he can go legally because the Supreme Court won’t hear a stay like that. IANAL, but all this does effectively is keep Mayfield suspended until his suit against NASCAR gets underway.

But that’s all a moot point anyway, because it’s been announced today that the assets of Mayfield Motorsports have been sold to John Carter, who has been putting together a team for Terry Labonte and Boris Said in the 08 car. That’s interesting to me because Carter was preparing Fords for Boris, but Mayfield’s operation was with Toyotas and Labonte will be running an unsponsored Simo Carter née Mayfield Toyota this weekend at Indy.

The Jeremy Mayfield saga keeps taking unpleasant turns. According to sources for ESPN: The Magazine, Jeremy Mayfield’s mystery amphetamine that he tested positive for (not the Adderall that we already knew about and was the source of contention) was methamphetamine, which is a whole…different…deal. There will be Mayfield apologists out there who will question the veracity of these sources, as all parties to the lawsuit are under a gag order and this second amphetamine was redacted from all public information about the suit. But there’s no question that this is an extremely disturbing revelation to this already sad story.

  • ESPN: Penske says he’s set with Dodge deal
    A case where the headline really misses the boat in terms of what’s really going on. Roger Penske, soon to be a part-owner of Saturn (pending approval), said that he plans to stick with Dodge as a manufacturer for at least the three remaining years of his contract with them. People who read that might consider that a vote of confidence for Dodge, but it’s not. Three years from now, Penske will finally have his Renault-powered Saturn Aura being sold across the country and will be in a position with R&D to develop brand new engines for his team. He went on to say that the Saturn Aura is “tailor-made for NASCAR,” which is about as big a hint as I’ve ever seen as to what Penske’s aims are with Saturn and NASCAR.

    You have have seen this already, it slipped by on Friday without my being able to mention it. However, NASCAR has gone ahead and filed a countersuit against Jeremy Mayfield. This is definitely a vindictive move. NASCAR can use this as leverage to keep Mayfield out of the sport almost as long as they want. They keep Mayfield’s money tied up in the courts sorting all this out for as long as his own suit against NASCAR remains active. If Mayfield’s suit gets settled, this will disappear.

    I don’t usually link to these things. If you’re interested in the serious commercial breakdown, you probably know about this. I only link to this for one reason, for people who were really holding FOX to the fire for all the commercial breaks. They haven’t posted data for Dover yet, but at Charlotte, commercials composed 24% of the lengthy broadcast (110 minutes in a 458-minute broadcast), yet for TNT’s first go at NASCAR coverage, commercials composed 28% of their broadcast (67 minutes in a 237-minute broadcast). I only mention this to point out that most people have been silent about the number of commercials for TNT’s coverage, which probably means that FOX’s coverage was fine in this specific regard.

    NASCAR is starting a new program for bloggers called the “Citizen Journalists Media Corps,” which, frankly, sounds like a Soviet program for reporting your neighbors’ un-Russian activities for instant deportation to a “Solzhenitsynian” gulag. But, in reality, it’s a program to grant bloggers more access to NASCAR events, although NASCAR is clearly dancing around the word “blog,” maybe because of the perceived implication that we don’t wear pants or something.

    If you’ve ever played the Gran Turismo video game franchise, you know that this really isn’t NASCAR’s beat…or is it?
  • NASCAR.com/AP: Mayfield suspension case moved to federal court
    Seems to be just a technical maneuver, but it means Mayfield will not race at Pocono for sure, which was apparently his goal.

Entered into evidence as part of Jeremy Mayfield’s lawsuit against NASCAR, the Charlotte Observer has gotten ahold of NASCAR’s official substance abuse policy document. Now, I want to say first off that this isn’t anywhere NEAR as interesting as you might think. In fact, it reads pretty much like that dull document you might have gotten from your own employer—the one you probably skimmed over and thought, “This doesn’t apply to me.” Well, looking through it, it does make me wonder if Jeremy Mayfield thought the same thing—didn’t think twice about it, maybe signed an approval saying he read and understood it, and now look where he is.

Many have been wanting an answer from NASCAR as to what Jeremy Mayfield has been accused of taking. According to Charlotte television station WCNC, we may have an answer. They are reporting that Mayfield’s attorney has said that NASCAR has accused him of using amphetamines and are filing a lawsuit against NASCAR and testing lab Aegis, “accusing NASCAR of unfair trade practices, negligence, defamation, breach of contract and breach of the Persons with Disabilities Act.” It goes on to say “Mayfield has said in the past that he has attention deficit hyperactivity disorder.”

This answers one basic question, but raises many more.

J.J. Yeley and the 41 Not Going to Dover

Overshadowed by the Dale Earnhardt, Jr./Tony Eury, Jr. saga, was the simple notification on J.J. Yeley’s website saying that he and Mayfield Motorsports will not be running this weekend in Dover. No word was given for why specifically, but surely it’s not easy to attract new sponsors to a team helmed by a driver accused of violating drug policy. The only two sponsors Mayfield had previously were the All Sport family of companies, of which CEO Gary Smith is still supposed to be a part owner, and that SmallSponsor.com, which was only running a one-month campaign, far as I know. So, the question is whether All Sport has backed out at this point of the venture or not. If so, that will likely be the end of the team altogether, but that hasn’t been verified yet. Jayski also said that Mayfield Motorsports sent all their employees home early on Tuesday. Also, clearly not a good sign.

This leaves 48 cars on the entry list for Dover.
